The aim of the Agreement was to address the immediate suffering of the Libyan people and build a democratic civil state through national consensus. The preamble underscored the importance of Libyan women in conflict prevention and resolution as well as the need to engage the youth in peace-making. The Agreement set out Governing Principles, including commitment to the Constitutional Declaration, affirmation of the principle of equality, independence of the judiciary and commitment to forming a government of national accord and to activating transitional justice and national reconciliation mechanisms in order to uphold the truth and achieve accountability, reconciliation, reparation and reform of state institutions.
The Parties agreed to the establishment of a Government of National Accord for one year, and set out the various modalities for its operation. The Government of National Accord would give the necessary consideration to the geographic dimension, cultural components and fair representation of women and youth when selecting its members and commit itself to the formation of a Women Support and Empowerment Unit under the Presidency of the Council of Ministers. The Agreement established the House of Representatives as the interim legislative authority, which also has the duty to appoint the Head of the Supreme Court, the High National Electoral Commission and the Public Prosecutor, among others. The Agreement also provided for a High Council of State as the highest consultative assembly of State, which may propose policies on inter alia national reconciliation efforts, national unity and assisting any fact-finding commissions.
The Agreement provided for confidence building measures, including through the establishment of an independent body on missing persons, protection of judicial authorities and implementation of Law 9 of 2013 on Transitional Justice, including the appointment of the Board of the Fact Finding and Reconciliation Commission and maintaining the independence of the National Council on Civil Liberties and Human Rights. The Government of National Accord would be responsible for developing a plan for the voluntary and safe return of refugees and IDPs. The Parties agreed to use the media to promote reconciliation, tolerance and national unity and to refrain from any form of violence, hatred or threat to civil peace.
The Agreement further set out security arrangements, including the composition and duties of the military force and the police and interim security arrangements such as monitoring arrangements for disarmament. The Government of National Accord would work towards developing strategies and plans that aim to integrate and rehabilitate members of the armed formations into civilian and military state institutions. The parties affirmed the importance of committing to finalise the Constitutional process. The Government would establish a reconstruction commission to coordinate reconstruction efforts in areas affected by the conflict.
